Welcome to Kappo. These Terms & Conditions ("Terms") govern your access to and use of the website www.kappo.in (the "Website"), and the purchase of products offered through it. By accessing the Website, browsing it, creating an account, or placing an order, you agree to be bound by these Terms. If you do not agree, please do not use the Website.

1. Eligibility
You must be at least 18 years of age and competent to enter into a legally binding contract under the Indian Contract Act, 1872, to make purchases on the Website. By placing an order, you confirm that you meet these requirements. Minors may use the Website only under the supervision of a parent or legal guardian who agrees to these Terms on their behalf.
2. Account Registration
You may be required to create an account to place orders. You agree to provide accurate, current, and complete information during registration and to keep this information updated. You are responsible for safeguarding your login credentials and for all activity that occurs under your account. Notify us immediately at contact@kappo.in if you suspect unauthorised use.
3. Products & Pricing
• All products listed on the Website are subject to availability. We reserve the right to discontinue any product without notice.
• Product images are for representational purposes. Actual packaging, weight, and appearance may vary slightly.
• All prices are listed in Indian Rupees (INR) and are inclusive of applicable taxes unless stated otherwise. Shipping charges, where applicable, are shown at checkout.
• We reserve the right to revise prices at any time without prior notice. The price applicable to your order will be the price displayed at the time of order confirmation.
• In the rare event of a pricing error, we reserve the right to cancel the order and issue a full refund.
4. Orders & Acceptance
Your order constitutes an offer to purchase. We reserve the right to accept or decline any order at our sole discretion, including (but not limited to) reasons such as stock unavailability, errors in pricing or product information, suspected fraud, or delivery limitations to your address.
A confirmation email is an acknowledgement of receipt of your order, not acceptance. The contract of sale is concluded only when your order is shipped from our facility.
5. Payment
Payments are processed through third-party payment gateways. We accept UPI, debit/credit cards, net banking, and other methods as displayed at checkout. We do not store your full card details. By making a payment, you authorise us and our payment partners to process the transaction.
Orders may be placed on a prepaid basis. Cash-on-Delivery (COD), where offered, is subject to additional terms and may not be available for all pin codes or order values.
6. Shipping & Delivery
Shipping terms, timelines, and charges are detailed in our Shipping Policy, which forms part of these Terms.
7. Cancellations, Returns & Refunds
7.1 Cancellation by You
Orders may be cancelled by writing to contact@kappo.in before the order is dispatched. Once dispatched, the order cannot be cancelled.
7.2 Cancellation by Us
We may cancel an order at our sole discretion. In such cases, the full amount paid will be refunded to your original payment method within 7–10 business days.
7.3 Returns
Because Kappo products are perishable food items, we are unable to accept returns once the product has been delivered, except in the following cases:
• You received a damaged, tampered, or leaking package.
• You received the wrong product or wrong quantity.
• The product is expired or close to expiry on delivery.
To raise a complaint, write to contact@kappo.in within 48 hours of delivery, with your order number, a clear description of the issue, and unboxing/product photographs. Complaints raised after 48 hours may not be entertained.
7.4 Refunds
Approved refunds are processed to your original payment method within 7–10 business days of approval. Bank or gateway timelines may apply. We may, at our discretion, offer a replacement or store credit in lieu of a refund.
8. User Conduct
You agree not to:
• Use the Website for any unlawful, fraudulent, or harmful purpose.
• Upload, post, or transmit any content that is defamatory, obscene, infringing, or otherwise objectionable.
• Attempt to gain unauthorised access to the Website, our systems, or other users’ accounts.
• Use any bot, scraper, or automated tool to access or collect data from the Website without our written consent.
• Interfere with or disrupt the operation of the Website or any associated servers.
9. Intellectual Property
All content on the Website — including the Kappo name, logo, product names, packaging design, copy, photographs, illustrations, videos, and the look and feel of the Website — is the property of Kappo Food India Private Limited or its licensors and is protected under applicable intellectual property laws. You may not copy, reproduce, modify, distribute, or create derivative works without our prior written consent.
Limited, personal, non-commercial use of the Website is permitted for the purpose of browsing and placing orders.
10. User-Generated Content
If you submit reviews, comments, photographs, or other content on the Website or on our social channels in response to a campaign, you grant Kappo a worldwide, royalty-free, perpetual, transferable, and sub-licensable right to use, reproduce, modify, publish, and display such content for marketing and promotional purposes, with credit where reasonably possible.
11. Disclaimers
The Website and all products are provided on an "as is" and "as available" basis. While we take reasonable care to ensure the accuracy of information, we do not warrant that:
• The Website will be uninterrupted, error-free, or secure at all times.
• Product descriptions, nutritional information, or other content is complete or current at all times.
• The products will meet every individual’s dietary, allergen, or health requirements. Customers with allergies or specific dietary needs are advised to read the pack label before consumption.
12. Limitation of Liability
To the maximum extent permitted by law, Kappo, its directors, employees, and affiliates shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising out of or in connection with your use of the Website or our products. Our total aggregate liability in connection with any order shall not exceed the amount paid by you for that specific order.
13. Indemnity
You agree to indemnify and hold harmless Kappo, its directors, employees, and affiliates from any claims, damages, losses, liabilities, costs, and expenses (including reasonable legal fees) arising out of your breach of these Terms, your violation of any law, or your infringement of any third-party rights.
14. Force Majeure
Kappo shall not be liable for any failure or delay in performance caused by events beyond its reasonable control, including acts of God, natural disasters, pandemics, government action, strikes, transportation disruptions, internet or power outages, or supply-chain failures.
15. Governing Law & Jurisdiction
These Terms shall be governed by and construed in accordance with the laws of India. Subject to the dispute-resolution clause below, the courts at Ernakulam, Kerala shall have exclusive jurisdiction over any disputes.
16. Dispute Resolution
In the event of any dispute, the parties shall first attempt to resolve the matter amicably through good-faith discussion. If the dispute is not resolved within thirty (30) days, it shall be referred to arbitration by a sole arbitrator appointed by Kappo, conducted in accordance with the Arbitration and Conciliation Act, 1996. The seat and venue of arbitration shall be Ernakulam, Kerala, and the proceedings shall be in English.
17. Changes to These Terms
We may update these Terms from time to time. The updated version will be posted on this page with a revised "Last updated" date. Continued use of the Website after changes constitutes acceptance of the revised Terms.
